Terms and Conditions

Thank you for shopping with The Luffy Store. We would like you to read our Purchase and Shipping Terms carefully to ensure that you are fully aware of your rights when purchasing products (the Products) from our website.

Your order signifies your agreement to be bound by these Purchase and Shipping Terms, which constitute the agreement between The Luffy Store ABN 17924804938 (weusour or The Luffy Store) and you.

 

PURCHASES

The Luffy Store reserves the right to review and cancel orders at any time.

You must provide complete and accurate details at the time of making your purchase. You may be required to provide additional details upon our request to ensure the accuracy of your order.

You must enter the correct delivery address and delivery instructions at the time of placing your order. If you enter an incorrect address, The Luffy Store is not obliged to re-send the order to the correct address at our own expense. 

 

PURCHASE PRICE

All prices quoted on the Website or pursuant to your enquiry with us are in Australian Dollars (AUD) and includes GST. Costs relating to international orders will be calculated via our integrated currency converter. The actual international currency conversion that you are charged via your bank may vary.
Buyers bear all responsibility for all extra custom charges incurred (if any).

We reserve the right to vary the prices displayed on the Website from time to time and without notice to you.

 

Australia Sales Only

We only sell and ship Products within Australia. We will not make deliveries outside of Australia.

 

Colours

We have done our best to display as accurately as possible the colours of the products shown on this web site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

 

PAYMENT

The Luffy Store accepts payment via Poli payments. We only accept Visa and Mastercard via Payitlater or Afterpay.

After you make payment for your order, we will email you an invoice, which confirms receipt of your order. Your order will be pending until the transaction has been processed successfully by our financial institution.

We have implemented a secure payment system to protect against fraudulent activity. In addition, we do not hold your credit card details after your order is completed, as they are submitted directly to our banks. If paying by debit or credit card, your account will be debited when you have completed Check Out. Payments made by PayItLater or Afterpay are subject to their terms & conditions.

Prices of all Products must be paid in advance. For this reason, your order will be executed if it is pre-paid. After you submit your order, our financial institution immediately contact your bank or card issuer for authorisation to take payment from your account. We will not process your order until payment has been received in full. When the payment is received in full amount, we will confirm this to you by sending you a further e-mail confirming the Product is being processed ready for dispatch (“Dispatch Confirmation”) at which point the contract between us ("Contract") will be formed. These Terms & Conditions, your order and the Dispatch Confirmation constitute integral and essential parts of the Contract.

 

CONSENT

By agreeing to these Purchase and Shipping terms, you also consent to receive further electronic communications from us in relation to The Luffy Store business, including information relating to products, competitions, promotions, special offers and any other commercial message. Of course, you may at any time, unsubscribe from receiving electronic commercial messages from us. Simply email us at info@theluffystore.com.

 

PROCESSING OF ORDERS

We process purchases on business days, which are Monday to Friday and exclude public holidays in Queensland.

We will provide you with a tracking number once we have shipped your order to you. 

You are responsible for any discrepancies or errors in your order caused by you. You must review your order carefully before placing it. Once an order is confirmed, you are unable to cancel or change it. 

You may place an Order by adding items to ‘My Cart’ on The Luffy Store website and clicking the "Check Out" button. When you place your Order, we will issue you with an Order Number. We will do this by email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. Information contained on The Luffy Store website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any products; however The Luffy Store will make every effort to supply products to you. We will notify you that your order is being processed by sending you an Order Confirmation via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. The Luffy Store and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when your order status moves to dispatched via email. If we cannot process or accept your Order after payment is received we will contact you via email.

 

SHIPPING and DELIVERY TIME

We source products from around the world delivery times will vary and we are delighted to offer free shipping across Australia. To enable us to deliver this to you, we have chosen an affordable shipping company. We aim to have all Australian orders shipped within 13-45 days.

COVID-19

Some deliveries may be impacted with a delay up to 60 days.

 

Authority to Leave

Delivery option you authorise via Australian Post to leave the goods unattended at the delivery address and you accept that once the courier has done so, the complete order has been received. Selection of Authority to Leave is deemed by our couriers as a signature from the recipient.

The Luffy Store and couriers associated with the delivery, do not accept responsibility for any loss or damage which results from the Authority to Leave delivery method. You agree to release The Luffy Store from and against any and all claims, demands, liabilities, losses, costs and expenses if Authority To Leave is selected.

Should the courier be unable to leave the parcel or deem the location to be an unsafe area to leave the parcel or your instruction text is unclear, the courier may leave an attempted delivery card and return the parcel to their depot.

Risk and title to the goods transfers to you after the first attempt at delivery irrespective of whether it was successful or not.

 

CANCELLATION OF ORDERS

The Luffy Store may cancel your order if for any reason we are unable to provide you with the Products subject to your order. We will contact you should this occur.

Failure to provide additional details upon request may result in cancellation and refund of the order. In the event that we cancel or are unable to fulfil your order, we will provide a full refund of any payment received.

You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation.

 

PRODUCTS MISSING FROM AN ORDER

Should a Product be missing from an order when received, please contact us at info@theluffystore.com with the order number and the product code or product name of the Product you ordered, so we investigate this further.

Please contact us if the goods are not received after 45 days so we can trace the package and locate where the package is. We will organise the delivery to you as soon as possible.

 

RETURNS POLICY 

We do not offer any returns or refunds for change of mind or if you have ordered the wrong sizes or colour. You are entitled to have the goods repaired or replaced if the goods are faulty, damaged or items not as described.

Refunds will be processed via original payment method only (unless store credit is requested) and all refunds are processed in the original currency of the order ($AUD). Any conversion loss will not be covered within the refund process. Store credit for returns will be valid for 12 months from the date and cannot be used in conjunction with other store credit. The store credit is valid for a one time use only. 

Within 7 days of receiving your reference number, return the item/s via trackable secure postage to the address provided within 20 days. Return shipping costs are not covered by The Luffy Store, and will not be included in your refund. 

  • Clothing should be returned unworn, unwashed, and in new condition with tag.
  • Footwear should be returned unmarked, an in original undamaged packaging. Please include any additional accessories (i.e. dust bag/ original shoe box) sent as a part of the order. The soles must not show any signs of wear.
  • All other items should be returned unmarked, and in original undamaged packaging. Please include any additional accessories (i.e. cleaning cloth, case) sent as part of the order.
  • Swimwear should be tried on over an underwear, with the original hygiene sticker in place. Unless faulty, The Luffy Store reserves the right to refuse an exchange or return if the hygiene sticker has been removed or tampered.

We will not process refunds for returns that are lost or damaged via return delivery to The Luffy Store.   

 

Faulty Items

We make the best efforts to quality control all items prior to dispatch.

In the case that something is faulty or damaged, please email us at info@theluffystore.com as soon as possible. We may require photos and a brief description of the fault to investigate the matter further.   

We offer repairs, replacement or full refund (including shipping costs).
Items damaged as a result of normal wear and tear or incorrect use/abuse, are not considered to be faulty or damaged.

 

Incorrect Items

If you believe you have received an item different to the one you ordered, please email us at info@theluffystore.com and include an order number and a brief description of the item you have received. We may require photos and a brief description of the fault to investigate the matter further. 

The Luffy Store reserves the right to deny unauthorised returns that do not meet or follow our return policy and procedures.

 

Legal Capacity to Transact

By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. If you are under the age eighteen (18) years you cannot place orders with The Luffy Store Should The Luffy Store suffer any damage or other losses as a result of a transaction entered into by a minor, The Luffy Store reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with The Luffy Store.

 

Force Majeure

The Luffy Store shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of The Luffy Store, and The Luffy Store shall be entitled to a reasonable extension of time for the performance of such obligations
